Today, the 17th Arbitral Appellate Court upheld the refusal to hold the former director and participant of LLC "Nordstroy-Engineering" subsidiarily liable.
The company's bankruptcy case lasted over 5 years.
The creditor and bankruptcy trustee attempted to prove that the director's actions led to debts exceeding 300 million rubles, imputing a violation of the duty to file for bankruptcy and failure to transfer documents.
Thanks to a well-chosen defense strategy, Enforce lawyers:
✔️ conducted an analysis of the company's financial condition and proved to the court that the bankruptcy was caused by objective reasons, not the director's actions;
✔️ won 13 separate disputes on recognizing transactions as invalid and the final dispute on subsidiary liability;
✔️ provided support for inventory procedures on Kamchatka at one of the creditors' deposits, which the bankruptcy trustee tried to evade.
Result:
The appeal confirmed — there are no grounds for subsidiary liability. The client is protected.
The Enforce Law team once again demonstrated a high level of legal protection in the bankruptcy field and proved that any case, even a complex one, can be won through coordinated and meticulous work.
