You can compensate for these losses through indexation. In 2025 the rules changed and the Supreme Court of the Russian Federation provided important clarifications. We explain how it works and what to pay attention to.

Deadlines: clarity has been introduced

Previously, the Arbitral Procedure Code (APC) had no deadline for filing an indexation claim. The Constitutional Court pointed out this issue in 2024, and amendments entered into force in April 2025.

Now you have no more than a year from the date of the debtor's actual execution of the court decision to demand indexation. Don't miss this deadline!

What can be indexed?

Not just the principal debt. Courts also index:

✅ Penalties and fines
✅ Other awarded monetary payments

How is the period calculated?

The calculation runs from the date following the issuance of the resolutive part of the decision until the date the funds are actually credited to your account.

Procedure: quick and simple

The application is filed with the same court that issued the decision. It is considered under a simplified procedure.

Can indexation be stipulated in advance in the contract?

Yes, and it's an excellent way to minimize the risks.
Leading lawyer at Enforce Law Company, Dmitry Ryjenkov, notes that parties rarely use this opportunity. However, in the expert's opinion, including such provisions in the contract can facilitate both pre-trial dispute resolution and faster execution of the court decision. The key is to ensure the economic justification of the indexation so that the court does not view it as an additional liability measure, Dmitry believes.
